Trademark Registration process in Pakistan involves several steps. Here’s a general outline of the procedure:
- Trademark Search:
- Conduct a thorough search to ensure that the trademark you want to register is not already in use or registered by someone else. This can be done through the Intellectual Property Organization of Pakistan (IPOP) database or with the help of a trademark attorney.
- Preparation of Application:
- Prepare the trademark application, which typically includes details such as the name of the applicant, the trademark itself, and the goods or services for which the trademark is to be used. You may also need to specify the trademark class.
- Filing the Application:
- Submit the completed application to the IPOP along with the required fees. The application can usually be filed online or in person.
- Examination by IPOP:
- After the application is filed, it will undergo examination by the IPOP to check for compliance with the legal requirements and to ensure there are no conflicts with existing trademarks.
- Official Journal Publication:
- If the trademark passes the examination, it will be published in the official journal. This publication allows third parties to oppose the registration if they believe it infringes on their rights.
- Opposition Period:
- There is typically a 2-month opposition period during which any third party can file an opposition against the registration of your trademark.
- Registration Certificate:
- If there are no oppositions, or if any oppositions are resolved in your favor, the trademark will be registered, and you will receive a registration certificate.
- Renewal:
- Trademarks in Pakistan are registered for ten years and can be renewed indefinitely for additional ten-year periods by filing for renewal before the expiry of the registration.
